Please watch MAR’s Letter of the Law below on Home Surveillance – Privacy Concerns.
As you may or possible may not know, more and more home sellers are using audio and/or video recording equipment to spy on buyers during showings and open houses.
In the event one of our sellers intends to do so, we are adding the following verbiage to the showing instructions in order to protect ourselves.
NOTICE FOR SHOWING AGENTS: AUDIO AND/OR VIDEO RECORDING MAY BE IN EFFECT
We have also added this to our open house registration form.
Buyer Agents Best Practice…
Please instruct your buyer clients to always act as if they’re being recorded. Further warn them to exercise cation when speaking to you or others while inside the seller’s home.
Seller Agents Best Practice…
Please caution your seller clients who wish to use surveillance devices during an open house or private showing that it is illegal to use any audio (eavesdropping) device during an open house or private showing without consent.
Eavesdropping Statute is defined as: To overhear, record, amplify or transmit and part of the private discourse of others without the permission of all persons engaged in the discourse.
Home Surveillance Statue does NOT prohibit security monitoring in a residence if conducted by or at the direction of the owner of that residence unless conducted for lewd or lascivious purposes.
